PRIVACY POLICY
At Not Knowing Corporation (“Not Knowing”, “we”, and “our”) we are committed to safeguarding the privacy of users of our Not Knowing™ brand websites and software products (collectively, the “Products”). This Privacy Policy sets out how we collect and administer the personal information of users of our Products (the “User,” “you,” and “your”).
Not Knowing and its licensors own, operate, and maintain the Products. Should you have any privacy questions or concerns you may contact Not Knowing by sending an email to privacy@notknowing.com.
By using the Products, you agree to the information collection and use policies and practices stated herein. If we make material changes to this Privacy Policy, we will notify users via our corporate website or by email. Any changes or additions shall be effective immediately upon the date of our initial notice. You are responsible for reviewing any notices we provide concerning this Privacy Policy. Any access or use of the Products by you after we provide notice of any such changes shall constitute and be deemed to be your acceptance and agreement to such changes.
BY USING OUR PRODUCTS, YOU AGREE TO THE INFORMATION COLLECTION AND USE TERMS STATED IN THIS PRIVACY POLICY. NOT KNOWING HAS THE RIGHT TO REVISE THIS PRIVACY POLICY AT ANY TIME.
Not Knowing may adopt and post additional privacy policies that apply only to specific Products. For example, we have adopted a privacy policy that applies to the current demonstration version of our Cleared Hot™ game. To the extent this Privacy Policy differs from the Cleared Hot privacy policy, the Cleared Hot privacy policy shall control.
1. Information We Collect
(a) Personal Information
We do not currently require Users to provide us with personal information before using the Products. Users of our website may voluntarily provide an email address to us for purposes of obtaining information and updates about the Products.
(b) Information About Your Browser and Devices
We may collect information about the web browser (“browser”) and computer or electronic device (“device”) you use to access and use the Products. This information may include unique device identifiers, your browser type and settings, device type and settings, and operating system. We may also collect information about the interaction of your browser and device with our Products, including IP addresses, crash reports, system activity, and the date and time you use the Products. We may collect your browser and device information whenever you use the Products from your device.
(c) Information About Your Use of the Products
We may collect information about how you use the Products. We may also compile and aggregate anonymous usage information from Users of the Products. You agree that we are authorized to use, reproduce, and generally use and make such usage information available to third parties, provided that such information does not include personal information about you or any other Users.
2. Our Use of Your Information
(a) Providing You the Products Functionality
We may use the information about your devices and browser we collect to automatically configure the Products for your use when access the Products. We may also use other information about your device, browser, operating system, and similar information to enhance your use of the Products.
(b) Communications with Users
We may use personal information like your email address to communicate and interact with you directly. For example, we may let you know about upcoming changes or improvements to the Products. If you contact Not Knowing for support or assistance in using the Products, we’ll keep a record of your request and our communications with you so we can better assist you in addressing the issues.
(c) Use of Mobile Phone Number
If we collect a mobile telephone from you, we may use the number to communicate with you concerning all aspects of the Products. Your mobile number will not be used for any other purpose. You may opt out of receiving electronic messages from Not Knowing at any time by texting STOP in response to a message received from us, or by emailing us at privacy@notknowing.com. We may continue using your mobile number for as long as you remain a User of the Products, or until you expressly revoke your consent to our use of your mobile number.
(d) Disclosures to Third-Party Information Processors
We may provide your personal information to third-party data processors as necessary to operate and provide the functionality of the Products, such as companies which host servers and process data for the Products. Not Knowing may provide your personal information to its subsidiaries, affiliates, professional advisors, and other third parties who provide services such as customer communications, hosting servers, data analytics, and other services for us. Not Knowing may only provide your personal information to these third parties as is necessary from them to provide their services to us, and the third parties are not authorized to use or disclose your personal information for any other purpose. Our third-party data processors will not use your personal information for any purpose other than those identified within this Privacy Policy and to enable Not Knowing to provide you with the functionality of the Products.
(e) When Disclosures to Other Third Parties May Be Made
Except for our third party data processors, we will not voluntarily share your personal information with a third party without your prior authorization, except (i) to enforce our privacy policy, to comply with law, regulation, or other legal processes or to protect the rights, property or safety of us or others, (ii) to a government regulator, law enforcement agency, or other public authorities, including to meet national security standards, (iii) in emergency situations, (iv) to protect against misuse or unauthorized use of the Products, (v) to detect or prevent criminal activity or fraud, or (vi) in the event that Not Knowing or substantially all of its assets are acquired by one or more third parties as a result of an acquisition, merger, sale, reorganization, consolidation or liquidation, in which case personal information may be one of the transferred assets.
(f) Our Use of Your Products Usage Information
We use the information that we collect about you use the Products to analyze, measure, evaluate, and improve or change the features and functionality of the Products. We may also use this information for product marketing, promotion, and sales purposes in our business discretion. We may share this usage information with third parties for marketing, advertising, or other similar uses. Your usage information will not include any personal information which identifies or can be attributed to a User unless we first notify you and obtain your express consent.
3. Cookies
We may collect information about your use of the Products with cookies. Cookies are data files that a software application stores on your computer’s hard drive or other memory for record-keeping and other administrative purposes. If you are concerned about the use of cookies, you can choose to enable a feature in your browser that will erase cookies, block all cookies, or warn you before cookies are stored or exchanged. If you reject cookies, you may not have access to all features or functionality offered by the Products.
4. The Legal Basis for the Processing of Your Personal Information
Our legitimate business interest for collecting our Users’ personal information is to operate the Products for the benefit of our Users in return for license, subscription, or services fees. We use the fees to pay our business expenses and operate Not Knowing, which is a for-profit business.
5. Reviewing, Exporting, and Deleting Your Information
You can review and correct any personal information we store in the Products by contacting us at privacy@notknowing.com.
You can have us delete your personal information from the Products by contacting us at privacy@notknowing.com. We will make reasonable commercial efforts to respond promptly to all such requests.
We may need to retain some of your personal information and content for limited periods for our legitimate business or legal purposes. Contact us for more information about our data retention periods and how long it takes us to delete your information.
6. Children’s Privacy
We are committed to complying with the Children's Online Privacy Protection Act of 1998 ("COPPA"), which requires us to inform parents and legal guardians about our information collection and use practices. COPPA also requires that we obtain parental consent before we allow children under the age of 13 to access or use the Products. We urge children to check with their parents before entering any information through our Products.
The Products are not intended for use by children under the age of 13. We will not knowingly collect any personal information from children under age 13 through the Products. If you think that we have collected personal information from a child who is under age 13, please contact us immediately at privacy@notknowing.com.
7. Notice for International Users
Users located outside of the United States (“International Users”) may only use our Products subject to the terms stated in this paragraph. All use of our Products by International Users is governed in all respects by controlling United States state and federal laws. This Privacy Policy may not comply with the data use and privacy laws of any foreign jurisdiction. Any personal information International Users submit to us will be collected, used, disclosed, transferred solely in the United States. International Users who choose to use the Products do so at their own risk. Personal information of International Users will be subject to lawful access requests from United States governmental agencies for as long as we store such information in the United States.
8. Third Party Websites, Distributors
The Products may contain links or provide access to third party websites or software applications. Not Knowing is not responsible for the privacy practices of these websites or applications. This Privacy Policy only applies to information collected by Not Knowing.
Not Knowing distributes certain of its Products via the Steam online delivery system pursuant to a distribution agreement with Valve Corporation. Any personal information or data that Value Corporation collects from Users through the Steam system shall be governed by the privacy and data security policies of Valve Corporation, and not this Privacy Policy.
Not Knowing also distributes certain of its Products pursuant to a publishing agreement with MicroProse Software Pty Ltd (“MicroProse”). Any personal information or data that MicroProse collects from users who license our Products from MicroProse shall be governed by the privacy and data security policies of MicroProse, and not this Privacy Policy.
9. Customer and User Consent; Changes
By using our Products you are consenting to the use of your personal information as stated in this Privacy Policy. You may withdraw your consent to the use of your personal information, unless you are withdrawing your consent to avoid a legal obligation to Not Knowing. Not Knowing’s continued use of your personal information after you withdraw your consent to its use, may be required for Not Knowing to comply with federal and state laws and regulations.
We will change this Privacy Policy periodically. We will not reduce your rights without your consent. The date at the end of this Privacy Policy indicates when the most recent changes to this Privacy Policy were posted. If changes are significant, we’ll provide a more prominent notice, including email notification. Again, if you acknowledge that you have reviewed an updated version of this Privacy Policy in response to an update notice from us, then you have expressly consented to the use of your personal information as stated in this Privacy Policy.
